Your access to or use of JTNC websites, materials, subscription services, software, indicators, alerts, automated or semi-automated technology and related services is subject to these Terms of Use and Disclaimers (“Terms”). Please read these Terms carefully before using any JTNC site or service. By accessing, purchasing, subscribing to or using a JTNC site or service, you acknowledge and accept these Terms.
If you do not agree to these Terms, do not access or use JTNC sites or services. JTNC Group, LLC reserves the right to amend these Terms from time to time. Important Disclosure Information
JTNC is a brand and trade name used by JTNC Group, LLC. JTNC Group, LLC provides general educational and informational content, software-based market analysis, trading indicators, signals, alerts, analytical tools, automated and semi-automated trading technology, subscription services and related investment-market information. Nothing provided by JTNC Group, LLC should be construed as personalized investment advice, a solicitation to effect transactions in securities, or a recommendation tailored to any user’s individual circumstances.
JTNC does not make representations or warranties as to the accuracy, timeliness, suitability, completeness or relevance of information prepared by unaffiliated third parties, whether linked to a JTNC website, incorporated into a JTNC service or made available through a third-party platform. Privacy Policy
At JTNC, we take privacy seriously. JTNC’s Privacy Policy, as published on JTNCGroup.com, is incorporated into these Terms.
Internet and Account Security
You are responsible for your own Internet connection, computers, devices, passwords, authentication methods, brokerage security, charting-platform security and other security measures used when accessing JTNC information or services. JTNC cannot be responsible for unauthorized access resulting from compromised credentials, insecure devices, third-party systems or circumstances outside JTNC’s reasonable control.
Third-Party Platforms, Brokers, Data and Connectivity
Certain JTNC services depend on or interact with third-party brokers, exchanges, market-data vendors, charting platforms, APIs, hosting providers, Internet service providers, payment processors and other technology providers. JTNC does not own or control those third-party systems and does not guarantee their availability, accuracy, speed, security, transmission, order acceptance, execution, fills or continued operation.
Users acknowledge that outages, data delays, stale or inaccurate quotes, API failures, broker restrictions, rejected or partially filled orders, slippage, exchange halts, connectivity problems, duplicate or delayed messages, platform errors and other events can affect the operation or outcome of a JTNC service. To the fullest extent permitted by law, JTNC is not responsible for losses or damages caused by third-party systems or conditions outside JTNC’s reasonable control.
Automated and Semi-Automated Services
Certain JTNC products may generate trading signals, select or analyze instruments, transmit orders, or support automated or semi-automated trading functionality when enabled by the customer. The customer chooses whether to subscribe to, configure and enable such functionality and remains responsible for the brokerage account, capital, permissions, settings, position size, risk limits and continued suitability of the service for the customer’s use.
Automated functionality does not guarantee that an order will be transmitted, accepted, filled, filled at an expected price, exited at an expected price or completed without interruption. Market conditions, broker rules, APIs, data, software, hardware and connectivity can affect execution. The customer is responsible for monitoring the brokerage account and for taking reasonable action when an automated or semi-automated service is unavailable or behaves differently than expected.
Website Terms of Use
Use of Material
JTNC either owns the intellectual property rights in the underlying HTML, text, images, audio clips, video clips, software, code, indicators, algorithms, documentation, signals, data displays and other content (collectively, the “Material”) made available through JTNC sites or services, or has obtained permission to use the Material. Except as expressly permitted in writing, JTNC prohibits the redistribution, copying, reverse engineering, resale, sublicensing, publication or commercial use of Material.
JTNC authorizes users to display, download or print pages or documentation solely for the user’s personal, non-commercial use in connection with an authorized JTNC service, provided copyright and proprietary notices remain intact and the Material is not altered, redistributed, broadcast, copied to other media or used to create a competing product.
Product names, company names, logos, trademarks and service marks displayed by JTNC are owned by JTNC and/or third-party licensors. No license or right to use any mark is granted except as expressly authorized in writing.
Disclaimer
JTNC websites, Material and services are provided for general informational, educational, analytical and software-based purposes. They do not create a client, advisory, fiduciary, brokerage, legal, tax, accounting or other professional relationship between the user and JTNC Group, LLC. Neither JTNC websites nor JTNC Material, software, indicators, signals, alerts, automated functionality or other services should be considered a substitute for the user’s independent investigation, judgment and risk management.
THE CONTENT, SOFTWARE, INDICATORS, SIGNALS, ALERTS, AUTOMATED FUNCTIONALITY AND OTHER JTNC SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, JTNC DISCLAIMS WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, TIMELINESS, AVAILABILITY AND ERROR-FREE OPERATION. JTNC DOES NOT WARRANT THAT ANY SERVICE WILL BE UNINTERRUPTED, THAT ANY SIGNAL OR ORDER WILL BE TRANSMITTED OR EXECUTED, OR THAT ANY RESULT WILL MATCH A HISTORICAL TEST, MODEL, EXAMPLE OR EXPECTATION.
You acknowledge that information, files, software, data and services obtained through JTNC or third-party platforms are used at your own discretion and risk. You are responsible for damages to your devices, systems, accounts or data resulting from downloads, integrations, third-party systems or use of the services, except to the extent liability cannot lawfully be disclaimed.
Limitation of Liability
To the fullest extent permitted by law, JTNC Group, LLC and its officers, directors, owners, employees, contractors, representatives and affiliates shall not be liable for damages arising from or related to the use of or inability to use JTNC sites, Material or services, including mistakes, omissions, interruptions, data errors, software defects, API failures, broker failures, rejected or delayed orders, slippage, execution differences, outages, viruses, delays, lost profits, lost opportunities, trading losses, loss or inaccuracy of data, loss of revenue, or direct, indirect, compensatory, punitive, special, incidental or consequential damages, even if JTNC has been advised of the possibility of such damages.
Termination
These Terms remain effective until terminated. JTNC Group, LLC may suspend or terminate a user’s agreement, subscription, access to JTNC sites or services, or any portion thereof if JTNC determines that the user has breached these Terms, failed to pay amounts when due, misused the service, violated intellectual-property or access restrictions, created security or operational risk, or otherwise engaged in conduct that JTNC reasonably determines warrants termination. JTNC also reserves the right to terminate a service or agreement without cause where permitted by the applicable subscription terms and law. Termination does not create a right to a refund except where required by law or expressly agreed by JTNC in writing.
Links to Third-Party Sites
JTNC sites or services may link to or interact with websites or platforms not maintained by JTNC. Such links and integrations are provided for convenience. Unless expressly stated, JTNC does not imply approval, sponsorship, endorsement or affiliation with third-party websites or services and is not responsible for their content, accuracy, availability, security or policies. Use of third-party sites and platforms is subject to their own terms and policies.
Enroll in Services
Access to certain JTNC services requires a paid subscription or other fee. When you subscribe, purchase, request access to or use a JTNC service, you agree to provide accurate, current and complete information requested by the applicable form, checkout, onboarding process or service configuration and to keep such information current. JTNC may suspend or terminate service if required information is materially inaccurate, incomplete or misleading.
If JTNC or a third-party platform issues credentials, access rights, API permissions, invite-only access or other authorization for use of a service, you are responsible for protecting that access and may not share, transfer, resell or permit unauthorized use. You are responsible for activity occurring through credentials or access assigned to you.
By separately opting in to marketing communications, or where otherwise permitted by law, you may receive information from JTNC regarding products, services or financial-market-related offers. Marketing communications may be opted out of using the method stated in the applicable message. Transactional, billing, access and service communications may still be sent as necessary to administer an active service.
Subscription Terms and Automatic Renewal
Monthly Subscriptions
A subscription expressly identified as monthly is a month-to-month subscription that renews automatically for successive monthly billing periods until cancelled. The customer may cancel a monthly subscription before the next scheduled renewal charge to stop future monthly renewals. Cancellation does not create a right to a refund or prorated refund for the then-current paid billing period.
Annual Subscriptions
A subscription expressly identified as annual is a fixed one-year subscription commitment. An annual subscription may not be cancelled early for convenience. The customer remains committed for the full annual term even if the customer stops using the service, requests that access be discontinued, changes brokers or platforms, or otherwise chooses not to continue using the service, except where applicable law or a written agreement with JTNC requires a different result.
If an annual subscription is paid in installments, the installment schedule is a payment arrangement for the one-year subscription commitment and does not convert the subscription into a month-to-month plan. Unless applicable law or a written agreement with JTNC provides otherwise, scheduled installments for the annual term remain due for the entire annual commitment.
If an annual subscription is designated to renew automatically, the customer must provide JTNC notice of non-renewal at least forty (40) calendar days before the end of the then-current annual term to prevent renewal for the next annual term. A non-renewal notice affects only the next annual term and does not shorten, cancel or refund the current annual term.
If annual non-renewal notice is received fewer than forty (40) calendar days before the end of an auto-renewing annual term, JTNC may process the next annual renewal in accordance with the subscription terms, except where applicable law requires otherwise.
The price, billing frequency, renewal status and subscription term displayed at checkout, in an order form or in a written product agreement are incorporated into these Terms. If a product-specific written agreement expressly conflicts with these general Terms, the product-specific agreement controls only as to that product and conflict.
Refund Policy
By paying a fee, a customer may immediately receive access to JTNC information, software, analytics, intellectual property, indicators, signals, automated technology, onboarding, configuration or other service benefits. For that reason, JTNC does not provide refunds except where required by applicable law or expressly agreed by JTNC in writing. JTNC’s Refund and Cancellation Policy published on JTNCGroup.com is incorporated into these Terms.
Miscellaneous
These Terms are governed by and construed in accordance with the laws of the State of Nevada, United States of America, without regard to conflict-of-law principles. You agree to personal jurisdiction in the federal and state courts located in Clark County, Nevada, and waive jurisdictional, venue or inconvenient-forum objections to those courts to the extent permitted by law.
If any provision of these Terms is found unlawful, void or unenforceable, that provision will be severed and the remaining provisions will remain in effect. These Terms are not assignable, transferable or sublicensable by the user without JTNC’s prior written consent. No waiver of a breach or default is a waiver of any preceding or subsequent breach or default. Headings are for convenience only and do not define or limit any provision.
These Terms, together with JTNC policies and any product-specific written agreements incorporated by reference, constitute the agreement between the user and JTNC relating to the subject matter covered herein and supersede prior or contemporaneous written or oral agreements to the extent they address the same subject matter.
